1. Preamble 

(a) This document is very important. We ask that you read it as it is intended to clearly communicate our terms, conditions and legal position. If you are unsure of anything, please contact us. You can contact us by completing a contact form or you can contact us by telephone by calling our authorized representative GBG Direction and Strategy on 03303 501265. You must accept our terms, conditions and legal position in its entirety in order to use this website or to engage with us in any way whatsoever and by any means. If you disagree, please leave the website. This document in its entirety is intended to replace every other document that is similar within the project now and retrospectively. This document was/is issued in May 2016. 

2. Our Legal Position 

(a) Please note we are not:

(i) Barristers (Legal Services Act [2007] (S181)(1));

(ii) Solicitors (Solicitors Act [1974] (S21));

(iii) An incorporated body (Administration of Justice Act [1985] (S9 and S9A)).

(iv) We are not regulated by the Bar Standards Board, the Law Society, the Ministry of Justice (MoJ), the Solicitor's Regulation Authority (SRA) or any other regulatory body. As such we cannot give legal advice and none of our activities amount to the same.

(b) Use of terms on our website and throughout the project

(i) "Gareth Group Law" and "GBG Law" simply refers to our politically neutral interest in upholding fair access to and provision of services offered to people by the public sector and in lawfully campaigning for public bodies to adhere to legislation for the benefit of wider society.

(ii) The use of the word "Advocate" throughout our project is intended to be read as "non legal, community based Advocate". This is not the same as an "Advocate" within Court or within Solicitors firms or Barristers Chambers. 

(iii) Gareth Group Law/GBG Law is also not a registered charity or business - we are a grassroots project. We operate, where the Court gives us permission, as McKenzie Friends within Court and as Community Based (non legal) Advocates outside of the Court where we do not require permission to do so. 

(iv) Gareth Group Law and the wider Gareth Group is being rebranded. Where you see a variation across our project, Gareth Group Law and Gareth Bailey Group Law (GBG Law) shall amount to the same, The Gareth Bailey Group (GBG) and The Gareth Group also shall amount to the same. The use of the word "us" "and  "the project" shall amount to GBG Law/Gareth Bailey Group Law (GBG Law) - "you" shall refer to you as the person interacting with us regardless of whether you are a prospective Client, a Client, the subject of a case (for example a public sector body), a legal body or anybody else whatsoever. 

(v)  "The Wider Group" shall amount to The Gareth Group and the Gareth Bailey Group. 

(vi) Gareth Group Law and Gareth Bailey Group Law (GBG Law) are entirely separate from projects and organisations carrying the Gareth Bailey Group branding. 

(vii) This document is governed by law in England and Wales and we solely operate within its jurisdiction. 

viii) The terms and conditions here are equally applicable however communications occurs between you and us. This includes, but is not limited to, contact in person, by telephone, by Email, by fax or by post. 

(c) Any use whatsoever of this website or when you communicate with the project by any means signifies your acceptance of this document in its entirety and without limit.

(d) Where any term is not legally enforceable, the rest of the paragraphs shall continue to apply. 


3. Terms and Conditions of Use

(a) The Website

(i) Due to the resource limitations of our project, we cannot guarantee assistance to anybody. Nothing on this website and nothing communicated by us in any other form is intended to imply that a contract has been entered into, that there is a possibility of doing so or that we have any kind of liability to you whatsoever.

(ii) In using this website and in communicating with us by any means (including but not limited to contact in person, by telephone, in writing and by Email), you agree to hold Gareth Group Law/GBG Law and The Gareth Group/The Gareth Bailey Group (and its projects and organisations) harmless from any kind of legal redress. You use this website at your own risk and we make no guarantees about the accuracy of information on this website. We cannot guarantee that the computer or server you use is free from viruses or other harmful programs. We do our best to keep the website secure but we cannot guarantee that our website will not from time to time be compromised. You should use anti-virus and spyware monitoring tools when accessing this website. 

(iii) We nor our Agents, Helpers, Contractors or other representatives are responsible for any loss whatsoever caused. We do not make a profit from our work and we do not expect to be charged for helping people for free (we do recuperate our reasonable costs). We accept absolutely no liability for any other organisation, project, collaboration or similar howsoever formed or operated that we might suggest you contact or engage with. You waive any legal right to civil or criminal recourse by interacting with us in any way. 

(iv) You should not use any content on this website or any communication by any other means without first obtaining advice from a legal professional. If you act upon any guidance on this website or that is communicated by any other means by us without first obtaining legal advice from a legal professional, you do so entirely at your own risk. 

(v) Gareth Group Law/Gareth Bailey Group Law operates solely in England and Wales. 

(vi) Use of this website is governed by the law of England and Wales.

(vii) A wide range of intellectual property rights are used in and relating to this website including: our Trade Marks and Logos, the design, text, graphics and other content of the web pages and articles on this website together with all of the web addresses associated with those web pages and articles and all of the modifications to the software used on this website including, but not limited to, CSS. 

(viii) Gareth Group Law and Gareth Bailey Group Law (GBG Law) as one and the same are the owner of these intellectual property rights. 

(b) About these conditions

(i) We reserve the right to change these terms and conditions and our legal position without notice. It is important and it is your sole responsibility to keep up to date with them. By using this website and in continuing to communicate with us, you agree to us changing these conditions and our legal position without notice to the extent of us changing the terms and conditions in their entirety. 

(c) Technical 

(i) You cannot use this website for any unlawful purpose, to send spam, to invade anybody's privacy or to undertake any act that we consider to be detrimental to our project or the organisation more widely. We respect your right to free speech but our provision of guidance to you is always at our sole discretion in any event and even further than this particular paragraph. We ask that you please kindly remain diplomatic. In the first instance, if you have concerns, we would kindly ask you to contact us and we will do our best to help. 

(ii) You cannot use this website to change your data, anybody else's data or our data. Data is intended to be interpreted as "any information whatsoever stored by us". If we make a mistake, please let us know. 

(iii) You are not permitted to tamper with our website. 

(iv) You are not permitted to access the website on more than one device at a time or to access the website more than once in a 1 hour period. We reserve the right to exercise our discretion where it is reasonable to do so.

(v) You are not permitted to copy our website for legal or business use or to print any part of it. We do permit you to share our website on social media only where the website is shared on the basis that it shall not be used for legal purposes. We do not intend to enter into any legal contract with you whatsoever or to have any liability to you whatsoever. We reserve the right to withdraw access to our project at any time for any reason whatsoever. We do not permit you to share the website with anybody in any way associated to you with the intention of breaking the terms within this paragraph or the wider terms, conditions and legal position that constitutes this document in its entirety. 

(d) Use of Cookies

(i) We use cookies on this website to monitor performance, security, popular articles and pages and so that features of this website can operate including the facility, where we offer it, to log in. We give you the option to accept or refuse cookies but if you choose to refuse them, certain features of this website will not work.

(ii) We reserve the right to offer cookies to people to eat, where we meet them, at our sole discretion and we do not intend for you to take this document any less seriously in us doing so.
